Alderwoman Misty Thomas has filed a lawsuit against the City of Knob Noster and its city clerk and city administrator. The lawsuit requests that the court declare that she has the right to copy city records without having to pay the charges which ordinary citizens would pay, due to her position as an elected official. The city has taken the position that under Missouri law the Board of Aldermen acting as a group control all of the powers of the city; but an individual alderperson acting alone has no special power. Access to records has not been denied to Ms. Thomas, the only issue being whether she is required to pay for them as an individual member of the Board of Aldermen. The lawsuit asks the court to declare what Ms. Thomas’s rights are, and for attorney fees.
